FIXED –TERM CONTRACTS

Definition:
A contract that terminates on
The occurrence of a specified event
The completion of a task or project
A fixed date (other than normal retirement)

Exclusions
The provisions pertaining to fixed – term contracts do not apply to
Employees who earn above the earnings threshold (currently R 205 433 p.a.)
Employees of an employer who employs less than 10 employees (less than 50 in the case of an employer who has been in operation less than 2 years)
Employees where a statute / sectoral determination / collective agreement allows for fixed – term contracts to be entered into.
